Terms and Conditions - Amanda Hatton Photography

To ensure that the terms and conditions for Amanda Hatton Photography comply with Irish online business regulations, particularly those outlined by the Competition and Consumer Protection Commission (CCPC) , revisions and additions have been applied on 31/3/2025:

1. Services

1.1 Amanda Hatton Photography offers professional photography services in a private studio and at outdoor locations. The specific services provided will be agreed upon between the client and Amanda Hatton Photography and outlined in the corresponding invoice or contract.

2. Copyright and Image Ownership

2.1 The photographer retains full ownership and copyright of all images produced during the session, including but not limited to digital files, prints, and negatives.

2.2 Amanda Hatton Photography reserves the right to use any image produced during the session for promotional purposes, including public advertising or online distribution, without prior consent from the client.

2.3 The client may not alter, reproduce, publish, or use any images provided by Amanda Hatton Photography for commercial purposes without obtaining written permission from Amanda Hatton Photography.

3. Booking and Payment

3.1 A non-refundable deposit is required to secure the date and time of the session. The remaining balance is due on the day of the session unless otherwise stated in the invoice or contract.

3.2 In the event of cancellation by the client, the deposit will not be refunded.

3.3 Amanda Hatton Photography reserves the right to cancel or reschedule a session due to unforeseen circumstances. In such cases, reasonable efforts will be made to accommodate the client's schedule or provide a full refund of any payments made.

4. Right to Cancel (Cooling-Off Period)

4.1 In accordance with the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013, clients have the right to cancel their booking within 14 days of the contract conclusion without providing any reason.

4.2 To exercise the right to cancel, clients must inform Amanda Hatton Photography of their decision to cancel the contract by a clear statement (e.g., a letter sent by post or email).

4.3 If the client requests to begin the performance of services during the 14-day cooling-off period, they acknowledge that they may lose the right to cancel once the service has been fully performed. If the service has been partially performed, the client may be liable for reasonable costs incurred.

5. Liability and Indemnification

5.1 Amanda Hatton Photography will take reasonable care in the capture, processing, storage, and delivery of images. However, in the event of loss, damage, or failure to deliver images due to unforeseen circumstances, including but not limited to equipment failure, memory card corruption, or acts of nature, Amanda Hatton Photography's liability is limited to a refund of the session fee.

5.2 The client agrees to indemnify and hold harmless Amanda Hatton Photography and its representatives from any liability, claims, damages, or expenses arising out of or related to the session or use of images, including but not limited to personal injury, property damage, or any other harm caused by the client or any third party.

6. Model Release

6.1 The client grants Amanda Hatton Photography the irrevocable and unrestricted right to use and publish images for editorial, trade, advertising, or any other purpose and in any manner or medium.

6.2 If the client prefers not to have their images used for promotional purposes, they must inform Amanda Hatton Photography in writing before or during the session.

7. Confidentiality

7.1 Amanda Hatton Photography will treat all client information as confidential and will not disclose any personal or sensitive information to third parties without the client's consent unless required by law.

8. Data Protection

8.1 Amanda Hatton Photography complies with the General Data Protection Regulation (GDPR) and is committed to protecting the personal data of clients. Personal information collected will be used solely for the purpose of providing photography services and will not be shared with third parties without consent.

8.2 Clients have the right to access, rectify, or request the deletion of their personal data held by Amanda Hatton Photography. Such requests should be made in writing.

9. Governing Law and Jurisdiction

9.1 These terms and conditions shall be governed by and construed in accordance with the laws of Ireland. Any disputes arising out of these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Ireland.

10. Image Storage

10.1 Amanda Hatton Photography is committed to storing client images with a third-party cloud provider for a period no longer than 12 months from the date of delivery to the client. Efforts will be made to retain images longer than this period where possible or achievable.

By booking a session with Amanda Hatton Photography, you acknowledge that you have read, understood, and agreed to these terms and conditions.
